Public health investigators used the PulseNet system to identify illnesses that may have been part of this outbreak. CDC PulseNet manages a national database of DNA fingerprints of bacteria that cause foodborne illnesses. DNA fingerprinting is performed on bacteria using a method called whole genome sequencing (WGS). WGS showed that bacteria from all sick people’s samples were closely related genetically. This suggested that people in this outbreak got sick from the same food. As of March 26, 2024 a total of 11 people infected with the outbreak strain of E.… [read post]

It was roughly this same time a year ago when the banking industry in the U.S. was going through a series of serious events. Within the space of a few weeks during March through May last year, three of the five largest bank failures in U.S. history occurred. At the outset, a wider banking crisis was feared, but the Treasury Department, the Federal Reserve, and the FDIC acted forcefully, in effect backstopping all deposits, and the three bank failures did not lead to a systemic event. But while the immediate crisis was averted, many of the underlying problems – interest rate… [read post]

[An interesting report that helps explain why the messaging, tactics, and methods adopted by campus protestors have been so similar across the country.] The Wall Street Journal has an interesting article explaining how the leaders of campus protests learned some of their strategies and tactics from national organizations and outside activists.  It begins: The recent wave of pro-Palestinian protests on college campuses came on suddenly and shocked people across the nation. But the political tactics underlying some of the demonstrations were the result of months of… [read post]

[A Jewish journal argues the problem is not the Act's definition of antisemitism, but the larger anti-speech bureaucratic edifice.] Last week, the House of Representatives passed the Anti-Semitism Awareness Act of 2023 by an overwhelming margin. Some critics of the law are concerned about its definition of what constitutes antisemitism. My co-blogger David Bernstein thinks such criticisms are overblown, while Eugene Volokh fears the definition could chill legitimate (and non-antisemitic) criticism of Israel. The editors of Tablet have a slightly different take. They are not… [read post]

For the Balkinization symposium on David Pozen, The Constitution of the War on Drugs (Oxford University Press, 2024).Jennifer D. Oliva The United States has long waged a “costly, punitive, racist, and ineffective” drug war “that has been a failure on all counts.” Over the last half-century, Americans have sacrificed trillions of dollars to prop up a prohibitionist drug law and policy framework that has ensured ever-escalating and record-setting drug-related mortality and enshrined the United States as the world champion mass incarcerator. Introduction One approach to the meaning of language emphasizes the idea that meaning is conventional.  Thus, when we interpret a constitutional or statutory provision, we might like for the conventional semantic meaning of the word or phrase.  But there is another view in the philosophy of language that rejects the idea that all meaning is conventional.  This approach has its greatest intuitive appeal in the case of words like "gold" or "water" that refer to natural kinds.  Thus gold is the name of an element with an atomic structure, and water is the name for a… [read post]
